And truly they are. Not only do we have the issue of is a contractor really an employee, or are they a “Dependent Contractor.” That our courts have made this a new category that has become a reality.

To me this is just a bridge that has the same destination. It boils down to what is the intent of the agreement to hire and be hired.

This third category in the middle between employees and independent contractors

CRA has been cracking down on companies and independent contractors, who are not really all that independent.

The heart of the distinction between an employee and an independent contractor is; If they look like a duck, quack like a duck, then they are a duck! Regardless of what the Contract for employment says.

When CRA unwinds the relationship, it is very costly for both the employer and the worker.

When the thin veil of the employment contract is pierced then the Employment Standards ACT kicks. Tax deductions are lost, terminations, hybrid policies, and workers rights kick in.

Understand that CRA, Employment Standards, and Workplace Safety all want everyone to be an employee. Even the owners of their own company.

Fighting the inevitable can be a waste of time. Better to plan other strategies.

It will be interesting to see how CRA works things out with their own workers. I don’t think their own employment contracts stand up to the test
