*BREXIT UPDATE FROM CHAMBERS IRELAND*

No Deal Scenario

  • Chambers Ireland recently received an update from the UK regarding a meeting held with HMRC on Wednesday. They were informed that at present UK HMRC do not require Certs of Origin for goods arriving in the UK coming from third countries and are therefore not likely to require Irish goods arriving in the UK post Brexit/no-deal to be accompanied by a Cert of Origin.
  • They are informed also that in the event of a no-deal, client companies in the UK may request a Cert depending on their individual needs (re-exporting etc). This applies vice versa. Irish companies whose supply chain contains UK components may also need to apply for a Certs - this will depend on the needs of and requirements in the country of destination. In addition, companies using a Documentary Letter of Credit to finance shipments may be requested by the relevant bank to obtain a Certificate of Origin too. Should your members have questions about whether or not they will need a Cert of Origin, we advise that they examine their supply chain, check the requirements of destination third countries and also speak to their client/importer as to their own requirements.

Withdrawal Agreement Scenario

  • The status quo will continue as normal for the duration of the transition agreement

Future Trade Deal

  • In the event of a trade agreement between the UK and EU in the future, preferential movement certificates will likely be required but in Ireland, these documents are issued by Revenue, not Chambers.

This clearly outlines the approach they will need to take and what obligations and requirements are to be met.

The DPC has published guidelines in relation to the flow of personal data in the event of a no deal Brexit. 

If the Withdrawal Agreement is adopted, the status quo will remain for the transition period from 30 March 2019 until 31 December 2020, it would be anticipated that the UK would be granted equivalence status during the transition period.

If there is a no deal Brexit there will be a distinction between data transfers from the UK to Ireland and data transfers from Ireland to the UK.  The UK will become a third country, resulting in the need for additional safeguards which will have to be put in place for data transfers from Ireland to the UK. In practice, this will mean using standard contractual clauses and most organisations are putting these in place within affected groups and with relevant service providers. 


The ICO (UKs Regulator)  has a very useful tool, a “contract building application” (https://ico.org.uk/for-organisations/data-protection-and-brexit/controller-to-processor-contract-builder/ ) which  if used, will ensure that standard contractual clauses are in place, the contract can be pre-populated and UK processors should be “encouraged” to use this form of contract ( to avoid the “battle of the forms” between data processors which occurred in the lead up to 25 May 2019).

Waterford-based Pimbrook Software, one of Ireland’s leading Sage Partners, has been selected as the Sage Partner Of The Year for 2018. Pimbrook was previously voted the Sage 50 Partner of the Year for 2015, 2016 and 2017, but this current accolade is of much greater significance as the winner was selected from all Sage Partners, regardless of their specialised product.
