FDA Regulation of Synthetic Nicotine Products

March 15, 2022 - Congress passed a law for the FDA to start regulating synthetic nicotine products. It set a deadline of July 13, 2022 for manufacturers of synthetic nicotine products to obtain FDA's authorization to keep their products on the market.


May 14, 2022 - A deadline passed, which was set by the FDA to clear the market of any flavored synthetic nicotine products that failed to submit marketing applications. All unauthorized synthetic nicotine products are now illegal and by law should be removed from the market.

FDA Proposed Rules: Menthol Cigarettes & Flavored Cigars

April 28, 2022 - The FDA issued proposed rules to prohibit menthol cigarettes and all flavored cigars.

August 2, 2022 - The public comment period ended for the FDA's proposed rules to eliminate menthol cigarettes and flavored little cigars.

Proposed Rule to Reduce Nicotine in Cigarettes

June 21, 2022 - As part of the President’s regulatory agenda, the Biden Administration and the FDA committed to issuing a proposed rule by May 2023 to reduce nicotine levels in cigarettes to minimally or non-addictive levels.

JUUL Settlement

June 23, 2022 - The FDA denied marketing applications for all current Juul products, but issued an administrative stay after Juul filed a lawsuit.  

September 6, 2022 - Juul agreed to pay $438.5 million in a settlement with 34 states and territories over its blatant marketing to kids. The Wisconsin share of this settlement is $14.4 million.
